「シンプルスピード」利用規約

利用規約の適用
１　「シンプルスピード」(以下、本サービス)のご利用に当たっては、シリコンスタジオ株式会社（以下、当社）が定める以下の規定が適用されます。また、Google Inc. が定める各種規約も適用されます。

２　本規約の内容と本規約外における本サービスの説明等が異なる場合は、本規約の規定が優先して適用されるものとします。

３　お客様が未成年者である場合には、必ずお客様の法定代理人（親権者等）とともに本規約を確認し、法定代理人の同意を得てから、本規約に同意してください。

利用規約の変更
１　当社は、お客様への予告を行うことなく本規約の内容を随時変更できます。なお、変更した内容につきましては、運営からのお知らせページにて直ちにお知らせします。

２　本規約の内容の変更後、お客様が本サービスのご利用を継続した場合、当社は当該変更をお客様が承諾したものとみなします。

禁止事項
１　お客様は以下に掲げる一切の行為を一切行ってはなりません。
①　犯罪的行為または公序良俗に反する行為
②　当社および第三者の財産、名誉、プライバシー等の権利を侵害する行為
③　虚偽の情報の提供または不正な目的での使用
④　本サービスの提供を妨げる行為または誹謗する行為
⑤　本サービスの内容を転載、複製、修正、蓄積または転送する行為
⑥　第三者に成りすます行為
⑦　その他本規約に違反する行為または法令に違反する行為
⑧　上記各号に該当するおそれのある行為

２　お客様は、当社の承諾なしに、当社に対するいかなる権利および義務も第三者に移転または譲渡することができません。

３　本サービスは日本国外に在住のお客様は利用することができません。

本サービスの解除
１　当社は、お客様が本規約に違反した場合には、何ら催告なしに本サービスに係る契約の解除または本サービスの使用の停止もしくは一時停止をすることができます。また、違反に該当するか否かは、当社の判断によります。

２　お客様が、本サービスのアプリケーションのアンインストールを行った場合、又はアプリケーションデータの消去を行った場合には、お客様は本サービスの解除を行ったものとみなします。

３　前２項に基づき当社が契約を解除した場合も、お客様は解除日を含むその日までに支払義務の生じた一切の債務について引き続き責任を負います。

免責事項
１　当社は、提供する情報についてその完全性、正確性等はいかなる保証も行いません。また、本サービスがいかなる環境下でも利用可能であること、お客様のプレイデータが反映されることを保証するものでもありません。

２　当社は、本サービスに不具合、エラーのないことの保証は行いません。

３　当社は、お客様への予告を行うことなく、本サービスを変更、停止または廃止することがあります。

４　以下に該当する場合、お客様への予告を行うことなく、本サービス提供の全部または一部を中断することがあります。
①　天災地変が発生した場合
②　社会的動乱、ストライキなどが発生した場合
③　火災、停電など不慮の事故が発生した場合
④　緊急のメンテナンス等、当社が必要と判断した場合

５　当社は、前項の他、当社の支配できない事由に起因するお客様の損害について、いかなる責任も負いません。

６　当社は、お客様と他のお客様または第三者との間で生じた紛争には関知いたしません。

権利帰属
１　本サービスに係る著作権その他の知的財産権等一切の権利は、当社または当社がその利用の許諾を得ている第三者に帰属します。


準拠法および合意管轄
１　本サービスおよび本規約の準拠法は日本法とし、日本法に従って解釈されます。

２　本サービスおよび本規約に関し、お客様と当社との間で訴訟の必要が生じた場合、東京地方裁判所を第一審の専属的な管轄裁判所とします。

Application of the Terms of Use
